A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without legal authority.

"Since his release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.

The situation originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to answer human smuggling charges, he was held in federal custody.

In her decision, the judge pointed out that the authorities does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The legal challenge center on disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in Tennessee.

The judge, who was overseeing his petition to deportation in a Maryland district court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.
